A common misperception about statutory rape is that state codes define a single age at which an individual can legally consent to sex. Only 12 states have a single age of consent, below which an individual cannot consent to sexual intercourse under any circumstances, and above which it is legal to engage in sexual intercourse with another person above the age of consent.
- In South Dakota, it is illegal for an adult (someone 18 or older) to have sex with a minor (someone younger than 16), even if the sex is consensual. Those who break the law have committed statutory rape. Statutory rape laws are premised on the assumption that minors are incapable of giving informed consent to sexual activities.

Law on Underage Dating
My friend is 16 and she's dating a 19 year who will be 20 in about a month. Her parents don't have a problem with it and she doesn't understand why it's wrong. I was wondering what the law is on underage dating in South Dakota. I know they can't have sex because he is more than 3 years older than her but what other consequences could happen as a result of their relationship?

Re: Law on Underage Dating
Merely dating without having sex should not present any legal problems, especially if the girl's parents approve of the relationship.
